What is workers’ compensation?

Is workers’ compensation only applicable if the incident happened on work grounds?

Not always, as long as your injury pertains to your job or is job related you may be eligible for benefits.


Are all work related injuries covered by workers’ compensation law?

On average, most injuries are covered by workers’ compensation. However, there are exceptions if the worker or employee was:

  • Under the influence at the time of injury
  • Committing a serious crime
  • Self-inflicted injuries
  • Not on the job
  • Employee was not following company policy or safety regulations


How do I know if I qualify for workers’ compensation?

Typically you must meet three requirements to know if you qualify for workers’ compensation.

  • You must be a legal and rightful employee
  • Your employer must carry workers’ compensation insurance
  • You must be suffering from a work related injury


What is the process for filing workers’ compensation?

You must first notify your employer of the type of injury, how it occurred, the date, time, and incident of the location, additional individuals how may have been involved, and any emergency treatment you received as a result. How long after filing a claim does it take to get benefits?

Your claim must be investigated before you receive any benefits if at all. Once you’ve submitted your claim your insurance company will begin to investigate by interviewing you and your employer. The insurance company will additionally review medication records and pertinent documents, you should cooperate with the insurance company for a quick decision. However, if you feel the insurance company is demonstrating unethical behavior, you have concerns about their investigation, or the insurance company will not return your requests for contact, contact us immediately. On average the investigative process to come to a decision can take anywhere between 14 – 30 business days.


What specifically are my benefits?

In the state of California workers’ compensation offers five general benefits:

  • Medical care
  • Temporary disability benefits
  • Permanent disability benefits
  • Supplemental job displacement benefits
  • Death benefits


What does it mean if my claim was denied?

It means the investigation yielded results that did not make you eligible for workers’ compensation benefits or you did not meet the required specifications. You may still file an appeal with your state workers’ compensation agency to dispute the denial and address the specific reason for which you were denied.


Will my employer fire me if I file for workers’ compensation?

It is illegal for your employer to fire you in regards to your open workers’ compensation case.
